私が今までFacebookに掲載した、専門学校卒業業に在留資格「技術・人文知識・国際業務」が不許可だった事例を挙げていきます。
Here is a compilation of cases I’ve previously posted on Facebook where vocational school graduates were denied the “Engineer/Specialist in Humanities/International Services” residence status.
不許可事例①
【学科】日中通訳翻訳学科
【就職先】輸出入業
【業務内容】月額17万円の報酬を受けて，海外企業との契約書類の翻訳業務及び商談時の通訳業
【不許可事由】申請人と同時に採用され，同種の業務に従事する新卒の日本人の報酬が月20万円であることが判明。日本人が従事する場合に受ける報酬と同等額以上の報酬を受けているとはいえない。
Case Example①
【Department】Japanese-Chinese Interpretation and Translation
【Employer】Import/export business
【Job Description】Translation of contracts and interpretation during business negotiations with overseas companies; monthly salary of ¥170,000
【Reason for Denial】A newly hired Japanese graduate performing the same duties receives ¥200,000/month. The applicant’s salary is not equal to or higher than that of a Japanese national.
不許可事例②
【学科】情報システム工学科
【就職先】料理店経営
【業務内容】月額25万円の報酬を受けて，コンピューターによる会社の会計管理(売上，仕入，経費等)，労務管理，顧客管理(予約の受付)に関する業務
【不許可事由】会計管理及び労務管理については，従業員が12名という会社の規模から，それを主たる活動として行うのに十分な業務量があるとは認められないこと，顧客管理の具体的な内容は電話での予約の受付及び帳簿への書き込みであり，当該業務は自然科学又は人文科学の分野に属する技術又は知識を必要とするものとは認められず，「技術・人文知識・国際業務」のいずれにも当たらないことから不許可となったもの。

【Department】Information Systems Engineering
【Employer】Restaurant management
【Job Description】Accounting, labor, and customer management via computer; monthly salary of ¥250,000【Reason for Denial】The company size (12 employees) does not justify sufficient workload for primary duties. Reservation handling by phone and ledger entry does not require specialized knowledge in science or humanities.

【学科】ベンチャービジネス学科
【就職先】バイクの修理・改造，バイク関連の輸出入
【業務内容】月19万円の報酬を受けて，バイクの修理・改造に関する業務
【不許可事由】フレームの修理やパンクしたタイヤの付け替え等であり，当該業務は自然科学又は人文科学の分野に属する技術又は知識を必要とするものとは認められない。

【Employer】Motorcycle repair/customization and import/export
【Job Description】Motorcycle repair/customization; monthly salary of ¥190,000
【Reason for Denial】Tasks like frame repair and tire replacement do not require specialized knowledge in science or humanities.

【学科】国際情報ビジネス科
【就職先】中古電子製品の輸出・販売等
【業務内容】月18万円の報酬を受けて，電子製品のチェックと修理に関する業務
【不許可事由】パソコン等のデータ保存，バックアップの作成，ハードウェアの部品交換等であり，当該業務は自然科学又は人文科学の分野に属する技術又は知識を必要とするもとのは認められない。

【Employer】Export/sales of used electronics
【Job Description】Checking and repairing electronic devices; monthly salary of ¥180,000
【Reason for Denial】Tasks such as data backup and hardware replacement are not considered to require specialized knowledge.

【不許可事由】専門学校における出席率が70％である者について，出席率の低さについて理由を求めたところ，病気による欠席であるとの説明がなされたが，学校の欠席期間に資格外活動に従事していたことが判明。
Case Example ⑤
【Reason for Denial (General)】Applicant had a 70% attendance rate at vocational school. Although illness was cited, it was found that the applicant engaged in unauthorized work during the absence period.
不許可事例⑥
【就職先】ビルメンテナンス会社
【業務内容】将来受け入れる予定の外国人従業員への対応として，通訳業務，技術指導業務
【不許可事由】将来の受入れ予定について何ら具体化しておらず，受入れ開始までの間については，研修を兼ねた清掃業務に従事するとして申請があり，当該業務が「技術・人文知識・国際業務」のいずれにも当たらないため。

【Job Description】Interpretation and technical guidance for future foreign employees
【Reason for Denial】Future hiring plans were not concrete. Until then, the applicant would perform cleaning duties, which do not qualify under the designated visa categories.

【就職先】ホテル
【業務内容】予約管理，通訳業務を行うフロントスタッフ。入社当初は，研修の一環として，1年間は，レストランでの配膳業務，客室清掃業務にも従事。
【不許可事由】ホテルにおいて過去に同様の理由で採用された外国人が，当初の研修予定を大幅に超え，引き続き在留資格該当性のない，レストランでの配膳業務，客室清掃等に従事していることが判明したため。

【Job Description】Front desk duties including reservation management and interpretation; initial one-year training includes restaurant service and room cleaning
【Reason for Denial】Previous foreign hires continued working in non-qualifying roles beyond the training period.

【就職先】人材派遣会社
【業務内容】翻訳・通訳業務に従事
【不許可事由】労働者派遣契約書の職務内容には，「店舗スタッフ」として記載されており，派遣先に業務内容を確認したところ，派遣先は小売店であり，接客販売に従事してもらうとの説明がなされ，当該業務が「技術・人文知識・国際業務」のいずれにも当たらない。

【Reason for Denial】Job contract listed “store staff”; actual duties involved retail sales, which do not qualify under the designated visa categories.

【就職先】電気部品の加工を行う会社の工場
【業務内容】部品の加工，組み立て，検査，梱包業務
【不許可事由】工場には技能実習生が在籍しているところ，当該申請人と技能実習生が行う業務のほとんどが同一。申請人の行う業務が高度な知識を要する業務であるとは認められない。

【就職先】人材派遣及び有料職業紹介業
【申請内容】外国人客が多く訪れる店舗において，翻訳・通訳を伴う衣類の販売業務
【不許可事由】その業務内容は母国語を生かした接客業務であり，色彩，デザイン，イラスト画法等の専攻内容と職務内容との間に関連性があるとは認められず，また，翻訳・通訳に係る実務経験もないため。

【業務内容】営業部に配属され，販売営業業務
【不許可事由】専攻した中心科目は英語であり，不動産及び販売営業の知識に係る履修はごくわずかであり，専攻した科目との関連性が認められない。

【履修内容】専門科目としてCAD，コンピューター言語，情報処理概論等，一般科目において日本語を履修
【不許可事由】日本語の取得単位が，卒業単位の約2割程度しかなく，当該一般科目における日本語の授業については，留学生を対象とした日本語の基礎能力の向上を図るものにすぎないため。

【Reason for Denial】Japanese language credits only ~20% of graduation requirements; courses aimed at basic language improvement.

【学科】国際ビジネス専門学科
【履修内容】日本語，英語を中心，他に経営学，経済学
【不許可事由】当該学科における日本語は，日本語の会話，読解，聴解，漢字等，日本語の基礎能力を向上させるレベルに留まるものであり，通訳・翻訳業務に必要な高度な日本語について専攻したものとはいえないため。

【Reason for Denial】Japanese language courses were basic; not sufficient for professional translation/interpretation.
不許可事例⑳
【学科】国際コミュニケーション学科
【履修内容】日本語の文法，通訳技法等
【不許可事由】新規開拓を計画中であるとする海外事業分野において，日本語が堪能である申請人を通訳人として必要とする旨の雇用理由書が提出されたが，申請人の成績証明書及び日本語能力を示す資料を求めたところ，日本語科目全般についての成績は，すべてC判定(ABCの3段階評価の最低)であり，その他日本語能力検定等，日本語能力を示す資料の提出もないことから，適切に翻訳・通訳を目的とした業務を行うものとは認められないため。
